witProtected Health Information (PHI) is very important information about an individual’s health status or medical treatment that is created, received, stored, or transmitted by a covered entity subject to the Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule.
With the advent of health tracking and fitness devices, it has blown up the volumes and importance of protecting this data and ensuring meaningful insights for patient preventive care.
The Privacy Rule sets national standards for protecting the privacy of individuals’ PHI and gives patients rights over their PHI. Covered entities include healthcare providers, health plans, and healthcare clearinghouses, as well as their business associates who perform services on their behalf that involve the use or disclosure of PHI.
Under HIPAA, covered entities and business associates are required to implement appropriate administrative, physical, and technical safeguards to protect the confidentiality, integrity, and availability of PHI. They must also notify affected individuals and the Department of Health and Human Services (HHS) in the event of a breach of unsecured PHI.
Violations of HIPAA can result in significant penalties, including fines and criminal charges, depending on the nature and severity of the violation.
